Trimester 3
Unit Description: National Security Law
This unit immerses students in the expansive and under-discussed area of national security-focused executive power in Australia. After contextualising Australia’s intelligence relationships as part of democratic statecraft, the unit critically examines the principal legislation regulating Australia’s National Security-focused Intelligence Community and its fraught interface with internationally recognised human rights norms. The focus is on the Commonwealth’s principal disruptive and investigative powers, the warrants and Ministerial authorisations enabling their use, as well as the principal counter-terrorism, electronic surveillance, preventive justice, and closed justice provisions that cumulatively amount to the protection of Australia’s national security. In an area of executive power where public trust is key, students additionally critically engage with Ministerial, Parliamentary and Independent oversight mechanisms.

Learning outcomes
Upon completion of this unit, students will be able to:
- demonstrate a comprehensive understanding of the special studies area of the unit, with depth in some areas;
- apply expert research skills through the independent analysis, critical evaluation and careful synthesis of knowledge and evidence from a wide range of sources related to the subject matter of the unit; and
- present a clear, coherent and independent exposition of their knowledge and ideas related to the subject matter of the unit.

| Final Invigilated Examination - Assurance task | Yes | 50% | All offerings | There is a supervised exam at the end of the teaching period in which you are enrolled. The exam will be offered online with supervision via webcam and screen sharing technology. Coordinated by UNE Exams Unit. To pass this unit, you must achieve at least 50% in this task, and meet all other passing requirements in the unit. |
