Unit information
This unit introduces you to the theoretical foundation, conceptual bases and context of the law of property. You will explore how a property interest arises, how it may be construed or enforced, and how it may end.
You will also examine the statutory schemes of registration for both Old System Title land and Torrens Title land, how multiple property interests may co-exist and how the interest holders’ respective rights, obligations and remedies are ascertained. You will also consider the principles of native title.
Throughout this unit, you will build a range of transferable critical thinking and legal reasoning skills. This unit meets the Priestley requirements for property.

Learning outcomes
Upon completion of this unit, students will be able to:
- demonstrate a thorough understanding of the fundamental principles of property law and how complex property relationships are regulated by the State;
- use cognitive skills to identify legal issues and apply legal and theoretical principles to resolve property claims and ownership issues; and
- use initiative and judgment to critically analyse and evaluate information and concepts relating to interests and obligations in property and property rights with respect to co-ownership, Old System Title, the Torrens regime, priority rules, mortgages, leases, easements and covenants, native title, and critically evaluate the implications of property law principles in Australia.
