Renewing a Contract
It is important to plan ahead when thinking about contract terms. Students must not be admitted to a course delivered with a partner unless there is enough time left under the contract for students to complete the course under normal progression. If the time remaining under the contract is not sufficient, then Contract Renewal will need to be initiated to ensure that UNE is able to maintain its legal obligation to students.
The timelines for renewing a contract are long, and critical to the partner's lead-time for marketing to prospective students. As contract negotiations typically take as long as six months, dialogue should commence with the partner at least 18 months prior to the commencement of the next cohort that would finish after the current contract ends.
Typically, partners commence marketing 12 months in advance of a course starting, and they must get their publicity materials approved by UNE before they can use them. UNE will not approve promotional materials unless it is clear that there is sufficient contract duration to cover the course being marketed.
Procedure for Renewing a Contract
1. Prepare a comprehensive Business Plan.
2. Seek approval from School/Faculty Teaching and Learning Committee in an application which includes:
- The last Annual IPM Report where appropriate;
- The Business Plan;
- A recommendation report by the Directors of the administrative units with a direct responsibility for the project on the status and viability of the project;
- A completed UNE Legal Contract Compliance Statement appropriate for the project type.
3. If approval to renew is granted, an application which includes the above documentation should be made by the relevant Pro Vice-Chancellor and Dean to the Entrepreneurial Committee. The application should confirm that all necessary academic approvals have been obtained.
4. If the Entrepreneurial Committee endorses the renewal of Contract, the Legal Contract Compliance Statement must be signed by the Chair of the Entrepreneurial Committee. UNE Legal will then begin drafting the appropriate Contract Renewal.
