CPSU GENERAL STAFF ENTERPRISE BARGAINING

MINUTES OF MEETING

2:00pm - 5:00PM, WEDNESDAY 22 MARCH 2000

CONFERENCE ROOM, TC LAMBLE BUILDING

1. APOLOGIES

2. MINUTES OF THE PREVIOUS MEETING (22 MARCH 2000)

The minutes of the previous meeting were accepted.

3. CPSU LOG OF CLAIMS FOR GENERAL STAFF MEMBERS

The CPSU advised that they had not fully read the University's written response to the CPSU log of claims received on 21st March 2000 and therefore did not wish to comment on the letter at this time.

The CPSU advised however that a meeting of CPSU members was held at 1:00pm (prior to this meeting) and that the CPSU members have requested that the University provide the CPSU negotiating team with a written document to further clarify the 4% contingency component of the University salary offer.

The CPSU requested that the University reply before the next CPSU members meeting which is scheduled to take place on Wednesday 5th April 2000.

The CPSU advised that there are 3 key matters proposed by the University which are currently not accepted by CPSU members.

1. Contingent pay increases - there is no explanation on what targets need to be achieved by the University to attain the contingent 4% of the total 10% salary offer.

2. $1,000 certification/sign on bonus - the CPSU were advised that the University cannot achieve CPSU's claim. As the University has not provided an alternative offer for a sign on bonus, this response has been considered unacceptable to CPSU.

3. No compulsory redundancies - the CPSU cannot accept the University's current position that they could not commit to no "forced" redundancies of general staff over the next three years.

In response, the University advised that:

1. Contingent pay increases - the University advised that determination of targets would be a matter to resolve throughout negotiations but must provide for revenue to support salary increases and must be achievable, sustainable and in accordance with the University's strategic plans.

2. $1,000 certification/sign on bonus - the University confirmed that the quantum of the certification/sign bonus of $1,000 was not considered to be achievable against the University's current cash flow. The University, however, advised that this does not preclude negotiations for a different quantum if this matter is agreed to be pursued.

3. No "forced" redundancies - the University advised that redeployment or transfers are preferred rather than paying out the cost of redundancy packages. However, there are occasions where alternative employment, as a result of change, is not available and the CPSU's claim for no "forced" redundancies could present problems. However, the University agreed that while a commitment could not be given at this meeting, further consideration would be given by the University and confirmation will be given at the next EB meeting scheduled for Tuesday 4th April 2000.

4. INDUSTRIAL ACTION - CPSU

The CPSU notified that as at the CPSU meeting of 22nd March 2000, its members have voted to commence industrial action in support of their claims (in particular, the three key issues mentioned above) in the form of stop work meetings on:

  • Tuesday 28th March 2000
  • Wednesday 29th March 2000 (times to be advised)
  • Thursday 30th March 2000

This action will involve all officers and members of the CPSU in all areas.

The CPSU further advised that they would officially notify the University of their action on Wednesday, 23rd March 2000 via their head office.

The CPSU confirmed that they will to continue to negotiate with the University and will continue to meet with the University at the arranged meeting times.

The University advised that they were disappointed that CPSU has decided to recommend to its members to undertake this action at this time. The University confirmed that they are willing to continue negotiations with CPSU throughout the strike action.

5. SUMMARY OF MEETING

CPSU

It was noted that CPSU has not had sufficient opportunity to thoroughly review the University's response to the CPSU log of claims for general staff members tabled at the meeting of 22nd March 2000.

CPSU confirmed that:

  • CPSU will respond to the University's letter in response to the CPSU log of claims at the teleconference scheduled for Tuesday 4th April 2000.
  • They require the University to fully clarify what targets need to be achieved by the University to attain the further 4%.
  • The non-acceptance of the $1,000 certification/sign on bonus claim was considered by CPSU as a rejection by the University at the meeting of 21st March 2000.
  • They will not accept the position of the University of no guarantees of no "forced" redundancies of general staff over the next 3 years.
  • Their members will undertake industrial action, in the form of stop work meetings on the 28th, 29th and 30th March 2000 in support of these claims and that CPSU Head Office will officially notify the University on 23rd March 2000.
  • The CPSU will continue to negotiate with the University during the strike.
  • They acknowledge that in accordance with the Act, the University will deduct pay from striking staff and that the University will notify staff or administrative actions.

The University of New England

The University confirmed that:

  • They do not reject the claim of the certification/sign on bonus at this time, only the quantum of $1,000 which is considered unsustainable.
  • They acknowledge the importance of the redundancy issue and will pursue this matter further.
  • They are disappointed with CPSU's timing of the proposed action but understand that it is an action undertaken by its members.
  • CPSU acknowledges that in accordance with the Act, the University will deduct pay from striking workers and that the University will notify said workers.
  • They are willing to continue negotiations throughout the strike.
  • All matters continue to be negotiable.
