Unit Description

This unit introduces students to the legal climate in which Australian health care is practiced. Opportunities are provided to explore the law of torts pertaining to civil negligence and trespass against the person, basic criminal law relevant to health care practice, legislation concerning medication storage and administration, and the principles of professional ethics in health care.

  2. understand and apply moral reasoning principles to ethical health care practice;and

Students will engage in study of the legal and ethical principles that are central to the professional role and are basic competencies required of health care practitioners. Knowledge of these principles and their application to practice will be assessed through case studies in online quizzes and by written assignment, with written feedback provided to consolidate student learning.

Students will practise communication during participation in online discussion with students and the unit coordinator throughout the semester. They will develop their professional writing skills through preparation of the written assignment and lecturer feedback.

3 Global Perspectives
While individual statutes vary from place to place, legal and ethical principles have a universal application to health care practice within the legal climate of the State, to respect for the rights of individuals, and to practice that meets the standards set by professional bodies. Text book content and readings refer to both local and international approaches so that students gain a global perspective of the applications of legal and ethical principles to professional practice. This perspective is consolidated in online case study quizzes, the written assignment and feedback.

4 Information Literacy
Learning in this unit requires students to use the unit homepage and its links, and to conduct online searches to locate the websites for legislation in their state or territory, as well as the ethical competency standards of their professional body. Assessment is by two online quizzes and a written assignment that must be submitted to TurnItIn software before being e-submitted for marking. Feedback is supplied as individualized electronic reports.

These students are either current or future employees of health care systems in which they will be applying their knowledge of legal and ethical principles acquired in this unit to their daily practice and also teaching others by example and through communication. 6 Problem Solving
Students are provided with information on legal and ethical principles which they are then required to apply to complex case studies and real life situations. They are also required to solve the problems of using new technologies, finding resources to aid in their case analyses and managing large volumes of data. The online quizzes and written assignment offer opportunities for students to test their own problem solving skills in differing theoretical contexts and receive feedback on their work.

Students are expected to apply legal and ethical principles to practice within health care team situations and to identify appropriate lines of communicative responsibility in specified hypothetical cases. This is assessed by online quizzes and a written assignment. They are also expected to interact with other students and share information via the unit homepage online discussion board, for which they are reminded of professional courtesies and cautioned about defamation. This activity is moderated and encouraged by the unit co-ordinator but not formally assessed.
