Unit Description

This unit covers law which is commonly associated with ordinary business practices and activities. The title refers to a number of areas of law which shelter under one umbrella. Commercial law traditionally developed out of the law merchant arising out of industry practice. The nature of commercial law has radically changed due to legislative enactments designed to achieve broad policy objectives, such as consumer protection or industry regulation. Consequently, legal development in the area expresses tension between the traditional approach which emphasises certainty, practicality and business efficacy, and the statutory regimes which promote market regulation and consumer protection.
