| Unit Description |
This unit deals with the rapidly evolving area of Banking and Finance Law in Australia. It begins with a brief discussion of financial system regulation and the increasing role of 'deregulation and supervision' of Australian financial institutions. Recent reforms to regulate "authorized deposit-taking institutions" based on their functions, as opposed to regulating financial institutions based on their status per se (like banks), have fundamentally changed the legislative framework and broadened the focus for this unit. Reforms in consumer finance coupled with advances in electronic technology means that students should also be aware of the new Consumer Credit Code and understand that there are numerous financial payment systems and methods in addition to traditional bank cheques. |
