| Unit Description |
This unit builds upon Law of Torts I. Whereas that unit dealt with the general principles governing duty, breach and causation/remoteness in negligence law, Torts II considers the final element-quantum of damage-and also considers how negligence law operates in particular situations-pure economic loss, nervous shock, statutory authorities. Consideration is given to some of the raft of pro-defendant legislation recently passed as a result of the so-called public liability crisis. Torts II also provides a brief examination of a number of other torts-nuisance, trespass to the person and trespass to land. The unit is primarily concerned with giving students a good understanding of the black-letter law, and the skills to apply it to novel fact situations. However, students are also encouraged to take a critical view of the law, particular with regard to current tort reform. |
