1. Admission to Candidature

1.1. Applicants for admission to candidature for the degree of Master of Laws shall have fulfilled all of the requirements for admission to:

(a) a degree of Bachelor of Laws of an Australian university; or

(b) an equivalent qualification.

1.2. This course is available on a fee-paying basis only.

2. Approval of Course of Study

After admission to candidature candidates shall have a course of study approved by the Course Coordinator or nominee.

3. Requirements for the Degree

3.1. A candidate shall proceed to the Master of Laws by completing units to a minimum value of 48 credit points comprising:

(a) LLM 600;

(b) elective units from the following list to the value of 42 credit points: LLM 601, 602, 603, 604, 605, 606, 607, 608, 609, 610, 611, 612, 613, 614, 615, 616, 617, 618, 619, 620 and 621;

(c) complete the above requirements, in not more than 18 months in the case of a full-time candidate, and in the case of a part-time candidate, in not more than four years from the date of commencement of candidature;

(d) the candidate may enrol in one of LLM 619, 620 or 621.

3.2. A candidate shall proceed to the specialisation in Commercial Law by completing units to a minimum value of 48 credit points comprising:

(a) LLM 600;

(b) Elective units from the following list of Commercial Law units to the value of 42 credit points: LLM 601, 604, 605, 607, 613, 615, 616, 619, 620, 621, 622, 623, 624, 625, 626.

4. Extension of Time and Leave of Absence

In exceptional circumstances the school, on the recommendation of the Course Coordinator or nominee, may vary the requirements of Rule 3.1.(c) by:

(a) granting leave of absence from candidature for a period or periods totalling not more than 12 months and the period of such leave shall not be counted as part of the prescribed time of candidature; or

(b) extending the period of candidature for a period or periods totalling not more than 12 months.

5. Advanced Standing

5.1. Subject to Advanced Standing Rule 3 3.4.(d), a candidate may, on the recommendation of the relevant head of school or nominee, be granted a maximum of 30 credit points of advanced standing and/or credit as follows:

(a) a candidate may be granted up to 24 credit points of advanced standing for course work units that have been successfully completed towards a postgraduate qualification at this or another University prior to admission to candidature, provided that such units have reasonable correspondence with units offered by the school for the Master of Laws by Course work; or through other significant learning which the school considers equivalent to units prescribed for the Master of Laws; and

(b) a candidate who is a graduate of an Australian professional legal training course may be granted up to 18 credit points of unspecified credit.

5.2. A candidate who is readmitted to candidature following exclusion may be granted advanced standing by the school for units in which he or she previously satisfied examiners in terms of Rule 3.1.

5.3. A candidate who commenced a Master of Laws by Course work and major dissertation at the University of New England prior to 2005 may be granted advanced standing for all units successfully completed under the rules governing their degree, and shall also be entitled to advanced standing under Rule 5.1.(b) notwithstanding the total amount of advanced standing may exceed 30 credit points.

6. Admission to the Degree

6.1. A candidate who completes the degree program specified in this chapter shall be eligible for admission to the degree of Master of Laws.

6.2. The degree of Master of Laws may be awarded to candidates at the level of Honours, Class I or Class II; or at the level of Pass.

6.3. A candidate who complies with Rule 3.2. above shall be entitled to have the entry ?Master of Laws (Commercial Law)? recorded on their testamur.

7. Other Rules

The relevant provisions of Master of Economics Rules 1.7., 1.10., 1.11., 1.12., 1.13. shall apply where appropriate.
