Reproducing and Selling Copyright Material

Information for Schools, Printery, Bookshop and Financial Services

There are some circumstances in which UNE course materials may be sold via the on-campus bookshop. In order for this to occur, a number of UNE processes need to be observed to ensure all legal obligations, such as GST requirements, and Copyright compliance are met.

Copying the whole, or more than 10 per cent, of an out-of-print book for teaching purposes under the Part VB Licence for sale on a cost-recovery basis

Here are the steps you need to go through:

  1. Establish that the book is not currently available in print, by completing the form Copying Works Believed to be Unavailable for Purchase. Note: you should do this each semester the book is required. If the book becomes available commercially, please destroy remaining copies of the reprint and order the new edition via the bookshop.
  2. The book needs to be listed on the UNE booklist report (this is a GST requirement).
  3. Ask the printery to use a plain or black and white cover and include the following information clearly on the front
    i)An AR number, which can be obtained by phoning the Printery. Use the same AR number each time you reprint the out-of-print book.
    ii)The following copyright wording: 'Out of print work. This copy has been made by the University of New England under Section 135ZL of the Copyright Act 1968.'The following GST wording: 'This item is listed on the UNE booklist as being required by students undertaking [unit code - - - - ] and is sold GST free subject to the student providing a current student ID.
    iii)'Selling/Student price, determined by the School and calculated on a cost-recovery basis only. Once the School’s cost recovery has been determined, an additional 20 per cent may be added for material sold through the on-campus bookshop. A form is available to help you calculate this.
  4. Ensure that all bibliographic and copyright information appearing inside the book is included with the reprint.
  5. Ask the Printery to cover the book's ISBN and barcode with a sticker as these no longer apply to the reprints and may cause confusion later on.
  6. Only the number of copies you expect to need for the upcoming semester should be reproduced.
  7. The book may only be sold on a cost-recovery basis, taking into account valid Printery, Licence and on-campus bookshop costs. A form is available to help you calculate this.
  8. If the reproduction is in CD rather than print form, all of the above applies, and a Part VB warning notice is also required.

 

Compilations of Readings and other course materials reproduced under the Part VB Licence for sale on a cost-recovery basis

Here are the steps you need to go through:

  1. The following checks need to be performed before the reproductions are made. Note: if you are unsure about any of this, or need advice about copyright, please contact the Copyright Office on ext. 3227:
    i) Each reading (journal articles and book chapters) requires full bibliographic information, preferably as a UNE style reference.
    ii) Readings copied in reliance on the Part VB Licence, must comply with quantity restrictions outlined in the UNE copyright web pages @ www.une.edu.au/copyright
    iii) Articles from library online databases such as ProQuest and Expanded Academic ASAP, or from personal online subscriptions, must not be included.
    iv) If copyright third party images, diagrams, tables and so on are used they need to be for educational purposes (not merely to enhance the look of the course material) and need to be properly cited. See the UNE copyright web pages @ www.une.edu.au/copyright
    v) Unpublished material may only be used with copyright owner’s permission.
    vi) Material copied with permission from the copyright owner needs to indicate this. A copy of the permission should be kept on file, preferably in TRIM.
  2. The following information needs to be on the UNE style cover:
    i) An AR number, which can be obtained by phoning the Printery. Use the same AR number each time you reprint the set of readings.
    ii) The following copyright wording:‘This material has been copied by the University of New England under the provisions of the Educational Licence Part VB, in accordance with the Copyright Act 1968.'
    iii) The following GST wording: ' This item is listed on the UNE booklist as being required by students undertaking [unit code] and is sold GST free subject to the student providing a current student ID.'
    iv) Selling/Student price, determined by the School and calculated on a cost-recovery basis only. Once the School’s cost recovery has been determined, an additional 20 per cent may be added for material sold through the on-campus bookshop. A form is available to help you calculate this.
  3. Only the number of copies you expect to need for the upcoming semester should be reproduced.

 

General considerations and procedural responsibilities

  1. When the bookshop and Dixson Library have completed the form Copying Works Believed to be Unavailable for Purchase, the form is sent on to the Copyright Office before being returned to the School with advice on whether the required work can be reproduced under the terms of the Part VB Educational Licence. 
  2. When an AR number is issued, Printery is to alert the School to the existence of this web page that outlines the above copyright and GST compliance.
  3. AR Codes issued for a particular job, should be retained if the job is re-run, i.e. don’t issue a new code.
  4. It is the School’s responsibility, in consultation with the Copyright Office, to ensure that the requirements of the Part VB Licence are met.
  5. Where material is reproduced with permission from the copyright owner, it is the School’s responsibility to ensure that any conditions are met, and that a copy of the permission is retained on file.
  6. It is the Printery’s responsibility to ensure that the cover is either (for compilations and UNE copyright material) UNE style or, (where a whole book has been reproduced) in black and white, with the following clearly on the cover as appropriate, (i) AR number on the top RH corner, (ii) selling/student price on the lower RH corner, (iii) copyright wording if copyright includes third party copyright copied under Part VB, and (iv) GST wording as given by School in accordance with UNE guidelines.
